This research aims to indicate the type of Islamic State in terms of being civil or religious, and to show that the concept of the state must be indicated in the legal term, which indicated that it is a homogeneous group of individuals operating on a specific geographical territory subject to a specific organization, and to identify the Islamic state as a religious It was necessary to explain the theories that look at the emergence of states, such as the theory of the autocracy, the natural theory, the social theory and the legal theory, as well as the nature of the system of government in the Islamic State, where the researcher found that the Islamic State is a civil state and not a religious state.
