TitleCompensation for Damage Caused by Herbal Medicine

Abstract

The phenomenon of herbal treatment is a common one in Arab societies in general, and the Palestinian society in particular.People often use this treatment for several reasons, including: lack of confidence in the ordinary medicine, and lack of financial capacityconsidering the rising cost of doctors’compensations.However, herbal treatment has some risks and may cause some damages if not properly used. Thus, this study tackles this practical issue through clarifying the reality of herbal medicine, the Islamic ruling upon it, its purposes, and its controls.The study also clarifies the meaning of compensation for damage caused by herbal medicine, the reasonsfor this damage, and some related rulings and clarifications in this regard. This includes legality of compensation for the damage, the nature of valid damagesin this regard, how to determineamount and timing of compensation, and the effect of changing money purchasing power on the amount of compensation.
