Abstract

The research discusses the topic: "The rule of law and the tools of oversight and accountability in the Gaza Strip under Palestinian division", which is crucial under the continued political division, despite the huge challenges that face Palestinians in the daily life, knowing that the research is rare in its topic and content. It provides a critical approaching of the laws and practice tending to judge these legal texts and practices at the same time. The paper discusses the rule of law and the extent of the practice forms of political, administrative, judicial oversight, as the most important guarantees to the rule of law in particular in light of the Palestinian division, and to monitor to what extent the division contributed to obstruct practicing the rule of law. In addition, the research highlights the dysfunction of both in practice or in legal texts and forms of weakness and strengths, in an attempt to provide a critical reading of the topic away from propaganda. The research concluded some significant results, most notably that the division contributed to impeding the implementation of the rule of law and its requirements, which must put an end to it. The research concluded that the legislative, administrative, judicial and public control tools remained limited and deficient.
