Abstract

The interest appeared in the expression short-term substitutes of Freedom-Restricting Punishment (punitive detention). One of the most important substitutes is the electronic observation, which it's importance increases when it applies in the youngish for prevent them socializing with criminals and attempt refinement reform them far away from the jail organization. Especially when it's attached short-term punitive detention. The electronic observation means " Force the convicted or jailed person to stay in his home or place of residence during limited hours so that follow-up of the person subject to electronic monitoring. Of which makes us asks around what are justifications application of the electronic observation as substitute for prison punishment on the youngish? And is there bordered conditions yields during its application period? We tried to answer on this inquiries by the descriptive and analytic method. In addition to the comparative method between the legal laws and the Islamic law. Reaching to some important results and recommendations. We hope that we have been successful and reconcile
