Abstract

Unanimity of Muslim scholars (Ijtihad) has a significant importance and a variety of benefits. It is one of the bases of Islamic legislation that follows Consensus (al ijma) in importance and it is a step towards complete, real consensus. Its position is more essential than analogical reasoning (al Qiyas). Moreover, utilizing such a method represents the spirit of practical legislation in Islamic jurisprudence which helps scholars to reach rulings on different situations that are not implicitly decided about in The Holy Quran and Sunnah. In recent times, the Islamic world lacks political unity; therefore, unanimity of Muslim scholars (Ijtihad) is expected to be a key to achieve ideological and legislative unity. The researcher recommends/suggests using such a methodology not only in legislation and rulings but also as a model to be followed by Muslims in other aspects of life. : : .
