Abstract |
Muslim scholars agreed that three conditions should be met for any obligatory action: knowledge of action, knowledge that Allah ordained action and ability to perform action. However, scholars disagreed if Iman is a condition to any Islamic obligation. This issue con not be generalized because meeting the Sharia condition is not a must to make the action obligatory as all scholars state. For example, all scholars agree that impure (Wing Janaba) Muslims Wane to perform prayer and thus must remove impurities to make their prayer acceptable. As such, will disbelievers be punished for not performing some Sharia saws and worships? This is a controversial issue. ﻤﻘﺩﻤــﺔ ﺁﻟﻪ ﻭﻋﻠﻰ ،ﻟﻠﻌﺎﻟﻤﻴﻥ ﺭﺤﻤﺔ ﺍﻟﻤﺒﻌﻭﺙ ﻋﻠﻰ ﻭﺍﻟﺴﻼﻡ ﻭﺍﻟﺼـﻼﺓ ﺍﻟﻌﺎﻟﻤﻴـﻥ ﺭﺏ ﷲ ﺍﻟﺤﻤـﺩ ﻭﺒﻌﺩ ﺍﻟﺩﻴﻥ ﻴﻭﻡ ﺇﻟﻰ ﻫﺩﻴﻪ ﻋﻠﻰ ﺴﺎﺭ ﻭﻤﻥ ﻭﺼﺤﺒﻪ : ،ﻜﻠﻲ ﺩﻟﻴل ﻤﻥ ﺸﺭﻋﻲ ﺤﻜﻡ ﺍﺴﺘﻨﺒﺎﻁ ﻫﻭ ﺍﻟﻔﻘﻪ ﺃﺼﻭل ﻋﻠﻡ ﻤﻥ ﺍﻟﻬﺩﻑ ﺃﻥ ﺍﻟﻤﻌﺭﻭﻑ ﻤـﻥ ﺤﻘـﻴ ﻭﻟﻠﺤﻜـﻡ ،ﺍﻟﻤﻜﻠﻑ ﻭﻫﻭ ﻋﻠﻴﻪ ﻭﺍﻟﻤﺤﻜﻭﻡ ،ﺍﻟﺸﺎﺭﻉ ﻭﻫﻭ ﺒﺎﻟﺤﺎﻜﻡ ﺘﻌﻠﻕ ﻭﻟﻪ ،ﻭﺃﻗﺴﺎﻡ ﻨﻔﺴﻪ ﻓﻲ ﻘﺔ ﺍﻟﻤﻜﻠﻑ ﻓﻌل ﻭﻫﻭ ﻓﻴﻪ ﻭﺍﻟﻤﺤﻜﻭﻡ . |
