Abstract

Aim of the study: The study aims to preserve the heritage of the Fiqh, Islamic jurisprudence, scholars through the collection of the Fiqh cases presented by Imam Al-Hindwani in the field of Fiqh Al-Muamalat (Islamic commercial law). These cases were divided according to the various types of transactions, with a statement of the Fiqh scholars opinions in this regard, if any. Methodology of the study: The study depended on the inductive approach through tracing the cases raised by Abu Ja’far Al-Hindwani in their resources. The study then investigated these cases and concluded their rulings considering the different schools of Fiqh. The most important findings of the study: Imam Abu Ja’far Al-Hindwani, may Allah’s mercy be upon him, is a hanafi scholar of Fiqh who had a unique mentality that is clearly expressed in his opinions. He is close to the status of Mujtahid, which qualifies him to have his own opinion that may disagree with other Fiqh scholars, including the hanafi school of Fiqh. The presented Fiqh cases are characterized with a high level of accuracy, considering that they deal with a critical side of Fiqh, which is the side of Al-Muamalat (Islamic commercial law). The total number of discussed cases is fifty cases distributed over the study chapters and topics. The topic of selling included the largest share of these cases, which is eleven cases. The most important recommendations of the study: The study recommends the seekers of knowledge to highlight the role of the Imams of Fiqh, especially those who are not well-known to many of them. This is quite essential to the seekers of knowledge and the whole Muslim nation in resolving many issues of Fiqh. The study also recommends the seekers of knowledge to study Fiqh of the different imams because it helps them to broaden their intellect in this field in addition to understand several cases of Fiqh in a critical and comparative manner. Finally, the study recommends Islamic University of Gaza to highlight and pay more attention to such vital topics.
