TitleThe State Measures for the Prevention of Crime: Doctrinal study

Abstract

Department of Comparative Jurisprudence (Fiqh) Praise be to Allah, and peace and blessings be upon the chosen honest Prophet: The subject of this research includes the state precautionary measures in the prevention of crime. Study Aim: This study aims to outline the mechanisms and precautionary measures that the state should follow to reduce the crime and its prevention. Study Methodology: The researcher adopted the inductive-deductive approach. Study Findings: The study most important findings are as follows: The primary goal of the precautionary measures is preventive; it is designed to deal with the criminal risk inherent in the character of the offender, either to eliminate crime or to eliminate the factors that lead to crime. The preventive action is not effective as long as it remains confined to the police domain because the crime is no longer as it was in the past, traditional and simple, but there are a variety of crimes subject to the economic, social, cultural and political variables of the community. Crime derives its strength and movement from the entire societal structure and therefore the preventive work has become the duty of the community with all its segments and institutions. Study Recommendations: The most important study recommendations were as follows: The necessity of the activation of Hisba (Guarding against infringements) system in the community and the availability of proper conditions so that the guards against infringements do their work properly. The need to apply the original sentence on the convicted offender and not to replace it by financial fines in order to ensure the achievement of justice and deterrence and the reform of the offender and others. The need to adhere to what is stated in the study concerning the means and methods for the prevention of crime in the security, economic and social domain, and thus the state mainly ensures the prevention of crime and the elimination of its causes.
